The Court of Justice of São Paulo applied, this Monday (3/10), the interpretation of continuous crime and reduced the sentences of councilors and businessmen involved in the prostitution of teenagers in Porto Ferreira. Based on the thesis that recognizes criminal continuity (when the same perpetrators commit crimes of the same type in similar circumstances of time, place and manner of acting) the 2nd Criminal Chamber, by majority vote, reduced the sentences of eleven defendants, accused by crimes of gang formation, favoring prostitution, rape and corruption of minors. The TJ itself can appeal (infringing embargoes) based on the unsuccessful vote. The decision reformed judge Sueli Juarez Alonso's sentence.
Judges Roberto Mortari (rapporteur), Teodomiro Mendez (reviewer) and Roberto Martins de Souza (3rd judge) voted. The rapporteur was defeated. Businessmen, councilors and a public servant are accused of organizing parties in that city, attended by teenagers and children to practice prostitution. In April last year, the majority were sentenced to sentences of more than 40 years in prison. The most drastic reduction applied Belize Email List by the TJ favored the former president of the City Council, Luiz César Lanzoni, who had been sentenced to 45 years in prison. The Court limited his sentence to 10 years, under a closed regime. The waiter and deputy councilor Walter de Oliveira Mafra, who had been sentenced to 33 years and six months in prison, had his sentence reduced to 12 years and 8 months in prison, in a closed regime.
Businessman Carlos Alberto Rossi, sentenced to four years, gained the right to the initial open regime for eventual serving of a custodial sentence. Businessman Luiz Dozzi Tezza (sentenced to six years in prison) also benefited from the progression of the regime. The trial also benefited Nelson da Silva (7 years and 8 months of semi-open imprisonment), Paulo César da Silva (4 years and 2 months of semi-open imprisonment), Laércio Natal Storti (9 years and 8 months of imprisonment in a closed regime) Gérson João Pelegrini (7 years and 8 months of imprisonment in a semi-open regime), Edvaldo Biffi (9 years and 8 months of imprisonment in a closed regime), Luiz Gonzaga Mantovani Borceda (9 years and eight months of imprisonment in a closed regime), João Lázaro Batista (9 years and 8 months of imprisonment in a closed regime), Luiz César Lanzoni (10 years of imprisonment in a closed regime).
